Terms and Conditions

The information contained on this page, together with any related documents, outlines the terms and conditions upon which The Photo Club supplies the all courses to you, whether listed on this Website or provided by The Photo Club via other means. Please read these terms and conditions carefully and make sure that you understand them before booking any Courses. Booking any of our Courses constitutes acceptance of these Terms & Conditions.

I give consent for my child to participate in all The Photo Club activities. Activities may include, but are not limited to, Working with cameras, Modeling, Studio equipment, Working with arts and craft materials and outdoor/off-site photo walks. I acknowledge my child will be supervised by the course leader who has an enhanced DBS check and other relevant qualifications which you may request to see.

Booking

In order to book a Course, you must be at least 18 years of age with the legal capacity to enter into a binding contract. Parents or guardians may book Courses for children, providing the Course is suitable. If you are unsure if a particular course is suitable, please contact us before booking.

Course particulars

The particulars relating to each Course are as described on our Website, or otherwise as detailed by us separately. The Photo Club endeavour to provide the Courses according to the description provided, however, there may be circumstances in which the content is changed and you acknowledge that the content of the Course shall in all cases be subject to our absolute discretion. Whilst The Photo Club endeavour to ensure that the Course information is correct, The Photo Club does not warrant the accuracy and completeness of the material.

Unless otherwise stated, it is your responsibility to provide a camera, associated photographic equipment, suitable clothing and food when attending the Courses. Whilst The Photo Club cannot guarantee to meet all personal needs, you should provide information concerning any special requirements, such that we can endeavour to assist wherever possible.

Your obligations

Course attendees must comply with all reasonable instructions and requirements while attending the Course including health and safety rules and regulations and any other reasonable security requirements that may apply at the premises or location where the Course is held. The Photo Club reserves the right to remove any attendee from the Course should their behaviour be deemed inappropriate. In such event, no refund of course fees or other costs will be made.
In the event that a child is collected 15 minutes late, The Photo Club reserves the right to apply a discretionary charge for each late pick-up increasing thereafter every 10 minutes. The individual circumstances will be taken into consideration when applying this charge.

Code of conduct

The Photo Club is committed to providing an environment in which all individuals are treated with respect. The Code of Conduct policy is to ensure a safe and positive environment within The Photo Club’s meetings, courses, activities and events, by making all members and guests aware that there is an expectation of appropriate behavior, consistent with the values of The Photo Club, at all times. Organisations who book Courses with The Photo Club are responsible for maintaining and dealing with a breach of the Code of conduct.

This agreement constitutes the entire agreement and understanding of the parties and supersedes any previous

agreement relating to its subject matter. No variation shall be effective unless it is expressly agreed by you and The

Photo Club.

A legally binding agreement shall not come into existence until The Photo Club has accepted your offer to purchase a

Course by sending you a separate order acceptance confirmation email.

The Photo Club I a place where everyone feels comfortable and safe. To help us make this happen, please follow these simple rules:

Young people are expected to:

  • Be honest about accidents
  • Respect for each other, the staff & the venue
  • Be supportive of others
  • Treat all the equipment and venue with care
  • Communicate with everyone and listen to each other
  • Promote equality for all
  • No name calling/ no fighting / no stereotyping / no rumours
  • Not to use language/ words that will offend anybody
  • Not to smoke while participating in activities
  • Not to be under the influence of alcohol or drugs
  • Have FUN
  • Learn and participateAny misdemeanours and general misbehaviour will be addressed by a member of The Photo Club and reported verbally to the designated person. Persistent misbehaviour will result in dismissal from the club. Parents/Guardians will be informed at all stages. If equipment or venue is not treated with care and maliciously broken Parents/Guardians will be held responsible to cover the costs of damage.Personal possessionsAll personal possessions, including but not limited to, your photographs or any camera/computer equipment, are the sole responsibility of you. The Photo Club accepts no responsibility for any loss, damage, theft or otherwise, that may occur whilst attend the Courses.

    Cancellation rights

    Under the Consumer Contracts Regulations, you may cancel your purchase of a Course within a period of 14 calendar

    days from the date on which the agreement is entered into, subject to the conditions below:

  1. You must inform The Photo Club of your decision within the Cancellation Period by email.
  2. Your right to cancel and obtain any refund will be lost if you have given The Photo Club express consent to supplyany services during the Cancellation Period.

Payment

Payment should be made via BACS or cash. If full payment is not received 7 days before the start of the Course, The Photo Club reserves the right to cancel the booking and this agreement. An extra charge of 8% will be added if the payment is late. Course prices are subject to change at any time, but any changes will not affect prior bookings that have already been confirmed by us.

Intellectual property

The Photo Club remains the owner of the intellectual property in the Courses and the Study Materials. The Photo Club grants to you a non-exclusive, non-transferable licence for you to use the Study Materials for the sole purpose of your non-commercial use in connection with your receipt of the Course. You must not allow access to the Study Materials to any third party or use any part of the Course or Study Material provided by us for commercial purposes without obtaining a written licence to do so from The Photo Club.

You will own the photographs taken by you on your own camera and any copyright in them (subject to any third-party rights and consents) and you hereby grant The Photo Club a non-exclusive licence to use your photographs in any and all media, whether now known or hereafter invented, for publicity and promotion of The Photo Club and its services including for example, but not limited to, The Photo Club Website and exhibitions. In this event, The Photo Club shall take reasonable steps to ensure that you are acknowledged as the author of your photographs. Any failure of such acknowledgement shall not be deemed a breach of this agreement.

Liability for loss and/or damages of photographs through software and/or human error is hereby excluded.

Photography consent

You hereby give consent for any photographs that include you in the image, taken by a The Photo Club representative or by a fellow Course taker, to be used in The Photo Club media, whether now known or hereafter invented, for the purpose of publicity and promotion of The Photo Club and its services including for example, but not limited to, The Photo Club Website, promotional material and exhibitions. You may decline/withdraw this permission by informing The Photo Club in writing: info@thephotoclub.co

Any photographs depicting people will be suitable for the purpose they are taken for; only used for this purpose
and will not be excessive. They will not be held longer than necessary and will be destroyed/deleted if you request us to do so in writing.

Photography consent for children

We have so much to be proud of during sessions with The Photo Club. Our goal is to highlight the successes and achievements of young people who take part.
The Photo Club carry out ongoing marketing and communication activities to maintain a positive profile in the local community. Our common methods of marketing and promotion include broachers, newsletters, posters, newspaper, magazines, promotional videos, websites and social media. The Photo Club share images with other participants on the course which may include the young person and their work.

As parent, guardian or organisation of the child for whom you are booking the Course, you hereby give consent, in accordance with The Photo Club Safeguarding Policy 2018, for The Photo Club to use any photographs taken by The Photo Club or fellow Course takers, that contain images of the child for the purpose of publicity and promotion of The Photo Club and its services. This also may include filming or voice recording.

You may withdraw this consent at any time by informing The Photo Club in writing or via email to:

As parent, guardian or organisation of the child for whom you are booking the Course, you hereby give consent, in accordance with The Photo Club Safeguarding Policy 2018, for The Photo Club to use any photographs taken by The Photo Club or fellow Course takers, that contain images of the child for the purpose of publicity and promotion of The Photo Club and its services.

You may withdraw this consent at any time by informing The Photo Club in writing or via email to the-photo- club@hotmail.com

If you cancel a Course

With the exception of the terms under Statutory Consumer Contracts Regulations, if you cancel a Course the following charges will apply:
For the period of 1 month prior to the course start date, no refund will be given on cancellations. For a period of in excess of 1 month prior to the course start date, a 50% refund is obtainable on cancellations.

If The Photo Club cancels or postpones a Course

The Photo Club reserves the right to alter Course dates, venues and location where necessary without liability. Should this happen, The Photo Club will endeavour to provide as much advance notice as possible of any such change via the telephone and email particulars provided at the time of booking. If you are unable or do not wish to attend a Course at the revised location or date, a prompt and full refund will be given to anyone who has booked and paid. No compensation will be paid for any additional costs incurred. These provisions are in addition to your statutory rights. The Photo Club cannot offer refunds for cancellations due to circumstances outside its control (Force Majeure); including but not limited to, adverse weather, large scale transportation issues, major incidents or industrial action. The Photo Club will not be liable for any other costs incurred including (for example) travel charges or any consequential damages, even if The Photo Club was advised of these costs. In such an event, The Photo Club will endeavour to reschedule the Course but can offer no guarantee.

Afterschool Clubs

Afterschool Club Courses are weekly one-hour sessions held at the end of the school day within the school grounds every term. Full payment for the complete term Course of sessions is required in advance. There is a minimum number of participants needed to make a Course viable (usually 8) if this is not achieved then the Course will not take place, and a full and prompt refund will be made. In this event, The Photo Club will not be liable for any additional costs.

No refunds will be given for participant’s non-attendance once the term payment has been made, a place allocated and the after-school Course has started. However, if circumstances permit, it may be possible to defer attendance to the next available Course, an administration fee will apply.
If at any time the instructor/Course leader deems that the behaviour of one or more children is likely to cause disruption or danger, they can reasonably request they are controlled or removed by the parent or guardian if this doesn’t happen, The Photo Club will cease the presentation until the situation is resolved or terminate the presentation with no refund.

Children in primary school must be collected by a named person at the end of a Course, party or afterschool session and will not be allowed to leave unaccompanied unless permission has been specifically requested by a parent. Please notify The Photo Club or the school office (in the case of after school club) if a different person than normal will be collecting the child.

Cancelling an Afterschool Club Course before the start of the Course

Over 2 week’s notice – Full Refund
1-week notice – 50% Refund
Less than 7 days of start date – No refund

Third-party permissions

The Photo Club cannot be held liable for third party permissions which may be relevant to your use of photographs. The Photo Club will obtain permission from location owners to take photographs where a Course is held on location for private and personal use and shall advise any restrictions or conditions of which it is expressly made aware. However, you shall still be liable for third party permission.

You shall be solely responsible for third party permissions which may be relevant to your use of the photographs. This may include (without limitation) permissions in respect of the following appearing in your photographs: people, trademarks (such as company logos or names), paintings, sculptures, buildings.
The Photo Club advises all course participants to ask before photographing anyone else. However, please be aware that if you are photographed, The Photo Club cannot be held liable for any subsequent use by the photographer of that picture.

Data protection

The Photo Club undertakes to adopt appropriate technical and organizational measures in order to safeguard personal data, with particular regard to ensuring information is secure, accurate, kept only as reasonably necessary and only accessed by authorised personnel.
Non-sensitive personal data will be collected for the sole purpose of Course administration. This information may be used by us to: (i) perform our obligations and rights under this agreement. (ii) provide feedback (iii) contact you for marketing purposes with details of similar events organized by us.

The Photo Club will not pass on details to any 3rd party, nor send marketing communication to any individual who has requested their details not to be used for such purposes.
Confidential information shall not include information that: (i) is publicly available at the time of its disclosure or becomes publicly available (other than as a result of disclosure by the other party contrary to the terms of this agreement); or (ii) was lawfully in the possession of the other party, free of any restriction as to its use or disclosure prior to its being so disclosed.

You have the right to receive details of your personal information held by The Photo Club.
